İslam Hukuku'nda nevâzil ve fetva eserleri, günün problemli meselelerine yer veren bir alan olarak karşımıza çıkmaktadır. Vâkı`ât, havâdis de aynı türü ifade için kullanılan kavramlardır. Tezde, Karahanlılar devrinde yetişmiş es-Sadru'ş-Şehîd (536/1141)'in Umdetu'l-Fetâvâ adlı nevâzil türü eserinin tahkik ve tahlili ele alınmıştır. Tez, giriş, iki bölüm ve sonuçtan oluşmaktadır. Girişte konu ile ilgili kısa bir bilgiye, araştırmanın konusu, amacı, kapsamı, metodu ve kaynakları hakkında açıklamalara yer verilmiştir. İlk bölümde, nevâzil, nevâdir, vakı`ât, havâdis ve fetva kavramlarının tanımları ve nevâzil ile fetva arasında farklar üzerinde durulup, nevâzil ve fetva eserleri hakkında katalog bilgileri tablolar halinde sunulmuştur. İkinci bölümde es-Sadru'ş-Şehîd (536/1141)'in yaşadığı dönem ve dönemin siyasi durumu, yaşadığı dönemde ilmî ortam, hayatı, hocaları, öğrencileri, eserleri ve Umdetu'l-Fetâvâ hakkında bilgi, değerlendirme ve eserin tahkiki işlenmiştir. Bu tez ile nevâzil literatüründeki el yazma bir eser, okuyucusunun istifadesine sunulmuş ve alanla ilgili belli dönemdeki eserlerin katalog bilgileri iki kapak arasında toplanmıştır.
Nevâzil and fatâwâ studies in Islamic Law deals with the problems of today, and the expressions of vâkı`ât and havâdis are used for defining them. In the thesis, the verification and assay of a nevâzil type of study named as Umda al-Fatâwâ written by al-Sadr al-Shahid (536/1141) who lived during the Karakhanids era was taken into consideration. The thesis was formed by the sections of introduction, two separate chapters and conclusion. The introduction includes brief information about the subject and explanations about the subject, objective, scope, method and references of the investigation. In the first chapter, the concepts of nevâzil, nevâdir, vakı`ât, havâdis and fatwa are defined, the differences between nevâzil and fatwa is dwelled, and the catalog information about nevâzil and fatwa studies is given in tables. In the second chapter, the life, teachers, students and studies of al-Sadr al-Shahid (536/1141), his era and that era?s political and scientific condition, and the information, evaluation and verification of Umda al-Fatâwâ are treated. This thesis presented a manuscript study of nevâzil literature to the use of researchers, and the catalog information about the same field for a definite era was collected between two covers.
