Ülkemizde Avrupa Birliği uyum süreci ve bu süreçle birlikte ilerleyen anayasal veya yasal değişiklikler, temel hak ve özgürlüklerin kapsamı ve güvenceleri konusunda birçok gelişmeye imkân tanımıştır. Anayasa Mahkemesi‟ne bireysel başvuru yolu, birçok kişi ve kurum tarafından, insan haklarının korunması için yeni bir güvence mekanizması olarak görülmektedir. 07.05.2010 tarihinde kabul edilerek 12.09.2010 tarihinde yapılan halk oylamasıyla yürürlüğe giren 5982 sayılı yasa ile 1982 Anayasası‟nda bazı değişiklikler yapılmıştır. Bu değişikliklerden birisi de, Anayasa Mahkemesi‟nin yetkileri arasına, soyut ve somut norm denetimi yetkilerine ek olarak, birçok Avrupa devletinin anayasalarında öngörülen bireysel başvuru yolunun eklenmesidir. Dünya‟da kırktan fazla devlet, hukuk sistemlerinde bireysel başvuru yoluna yer vermiştir. Türkiye‟nin bireysel başvuru yolunu kabul etmesindeki temel amaç, Avrupa İnsan Hakları Mahkemesi‟nin Türkiye aleyhine vermiş olduğu ihlal kararları sayısını azaltmaktır. Bu amacın gerçekleştirilebilmesi için Anayasa Mahkemesi‟nin bireysel başvuruları incelerken etkili bir yargılama gerçekleştirmesi ve içtihatlarının Avrupa İnsan Hakları Mahkemesi içtihatları ile uyumlu olması büyük önem arz etmektedir. Bu çalışma; Anayasa Mahkemesi‟nin yapılan bireysel başvuruları incelerken esasa ve usule ilişkin riayet etmesi gereken kuralları tespit etmek ve Avrupa İnsan Hakları Mahkemesi ile çıkması muhtemel içtihat farklılıklarını belirlemeyi amaçlamaktadır.
The European Community harmonization process and constitutional or legal modifications which progress with that process provide lots of development about fundemantal rights and liberties‟ content and guarantees in our country. The individual application way to the Constitutional Court is seen as a new assurance mechanism for the protection of human rights by many people and institutions. Some changes were made in the 1982 Constitution with the law no. 5982 which adopted on 07.05.2010 and entered into force with the referendum on 12.09.2010. One of these changes is, like stipulated in the constitution of many European states, authorisation of Constitutional Court with holding individual applications, in addition to abstract review of norms and concrete norm control powers. More than forty states in the world took individual application way in their legal system. The main objective of Turkey's acceptance of the individual application way is reduction of the number of infringement decisions given by the European Court of Human Rights against Turkey. Constitutional Court should achieve effective judgment when reviewing individual applications and be compatible with the European Court of Human Rights case law for the realization of this goal. This work aims to determine procedure and principle rules must be obeyed by Constitutional Court while examining individual applications and specify possible differences of court practices with the European Court of Human Rights.
