Kamu idaresinin güvenilirliğine ve işleyişine karşı suçlar içerisinde TCK. m. 257’de düzenlenen görevi kötüye kullanma suçu, hukuki niteliği itibariyle genel ve tamamlayıcı bir suçtur. Bu yönüyle bir kamu görevlisinin TCK. m. 257’de yer alan suç kapsamında sorumlu tutulabilmesi için, kamu görevlisinin suça ilişkin eylemlerinin diğer bir Kanunda suç olarak düzenlenmemiş olması gerekir. Türk Ceza Kanunu dışında diğer bazı özel kanunlarda da kamu görevlilerinin görevlerini kötüye kullanmaları özel nitelikli suç tipleri ile düzenlenmiş bulunmaktadır. Ancak kanun koyucu kamu görevlisinin görevini kötüye kullanmasının, kamu idaresinin güvenilirliğine vereceği zararı dikkate alarak hiçbir şekilde cezasız bırakmak istememiştir. Bu nedenle özel kanunlarda suç olarak düzenlenmemiş eylemlerin de genel nitelikli bir suç olan görevi kötüye kullanma suçu kapsamında TCK. m. 257 hükümlerince cezalandırılmasını öngörmüştür. Böylece, kanun koyucu, görevin kötüye kullanılması yoluyla kamu idaresinin güvenilirliği ve işleyişine verilecek zararların engellenmesini amaçlamıştır.Görevi kötüye kullanma suçu, sadece kamu görevlileri tarafından işlenebilen bir özgü suç niteliğindedir. Suçun maddi unsurunu “görevin gereklerine aykırı hareket etmek suretiyle, kişilerin mağduriyetine, kamunun zararına ya da kişilere haksız kazanç sağlama” oluşturmaktadır. Bu nedenle, kişilerin mağduriyetine, kamunun zararına yol açmayan ya da kişilere haksız kazanç sağlamayan eylemler görevi kötüye kullanma suçunu oluşturmaz. TCK. m. 257’de düzenlenen suçun manevi unsuru genel kast olup, bu suça teşebbüs mümkündür. Görevi kötüye kullanma suçu genel ve tamamlayıcı bir hüküm olduğu için, görevi kötüye kullanmayı unsur olarak kapsamında bulunduran özel nitelikte bir hükmün bulunması halinde, ceza daha hafif olsa bile görevi kötüye kullanma suçundan faile ceza verilemez.
The crime of misconduct stipulated under article 257 of Turkish Penal Code which is among the reliability and functioning of public administration is a general and supplementary crime in terms of its legal nature. In this context, in order to hold a public official responsible under the scope of crime stipulated under article 257 of Turkish Penal Code, the acts of the public officials must not have been stipulated as crime under any other laws. Misconduct by public officials have also been stipulated as special nature crime types under some other special laws other than Turkish Penal Code. However, lawmaker has not intended to leave misconduct by public official without punishment taking into account the reliability of public administration. For that reason, it has been stipulated to punish the acts not stipulated as crime under special laws, under the scope of provisions of article 257 of Turkish Penal Code considering it among misconduct. Thus, the lawmaker has aimed to prevent damages to be caused to reliability and functioning of public administration by means of misconduct. The misconduct is in the nature of a crime unique in the way it can be committed only by public officials. The material component of the crime is constituted by ?act in contrary to the requirements of the duty, and thus to cause victimization of persons, to provide loss to public or provide unfair gaining to persons?. For that reason, the acts not causing victimization of persons, loss to public or providing unfair gaining to persons do not constitute misconduct. The moral component of the crime stipulated under article 257 of Turkish Penal Code is general intention and attempt to conduct such act is possible. As the misconduct is a provision, of general and supplementary nature, in case of any provisions in special nature covering misconduct as a component, even if the punishment is lighter, the person conducting such act is not imposed of punishment for misconduct.
