"Bonoda Ödeme" isimli bu çalışmanın amacı, bonoda ödeme kavramının ve ödemenin sonuçlarının incelenmesidir. Bu incelemeler, 01.07.2012 tarih ve 6102 sayılı Türk Ticaret Kanunu hükümleri esas alınarak yapılmıştır. Altı kitaptan oluşan Türk Ticaret Kanunu'nun, kıymetli evrakı düzenleyen üçüncü kitabının, kambiyo senetlerini ele alan dördüncü kısmının ikinci bölümü bonoya ayrılmıştır. Türk Ticaret Kanunu'nun 778'inci maddesinin birinci fıkrasının "b" ve "c" bentleri uyarınca, bononun niteliğine aykırı düşmedikçe poliçede vadeye ilişkin 703-707 madde hükümleri ve ödeme hakkındaki 708-712 madde hükümleri bono hakkında da uygulanacağından çalışmamızda bonoda ödeme kavramı açıklanırken poliçeye ilişkin 703-712 hükümlerinden yararlanılmıştır. Bu tez çalışması, iki ana bölümden oluşmaktadır. Birinci bölümde, bonoya ilişkin temel kavramlar başlığı altında bono kavramı, ödeme kavramı, bonoda vade türleri ve ödeme için ibraz kavramı kapsamlı bir şekilde ele alınmıştır. İkinci bölümde ise, borçluyu borçtan kurtaracak bir ödemenin şartları, tevdi ve ödemenin hüküm ve sonuçları kapsamlı olarak incelenmiştir.
The purpose of this study, which is called as "the payment of promissory note", is to examine the concept of payment of a promissory note and the consequences thereof. This thesis is based on the Turkish Commercial Code no. 6102. Turkish Commercial Code consists of six books. The third book is about negotiable instruments. In this third book, the second part of the fourth section regulates bills of exchange. Unless they run counter to the essential, the provisions governing maturity and payment of bills of exchange also apply to promissory notes. Therefore we used Art. 703-712 of the TCC during our explanations.This thesis consists of two main parts. In the first part, the requirements of the promissory note, the concept of payment, the types of maturity on a promissory note and the concept of representation for payment are being discussed. In the second section, the conditions of payment, deposit and the provisions and results of payment have been analyzed especially considering the conditions which release the debtor from the obligation.
